These terms apply to your access to and use of the Polywork platform, the Polywork AI coach, any live sessions or community spaces we run, and anything else we provide as part of your membership (together, the "Service"). By purchasing or using the Service, you agree to these terms. If you do not agree, please do not purchase or use the Service.
1. About these terms
We may update these terms from time to time. The current version will always be available at joinpolywork.com/terms. Where changes are material, we will take reasonable steps to let you know.
2. Definitions
- Platform: the Polywork web application and the materials, tools, and content within it.
- AI coach: the automated assistant built into the Platform that asks questions and produces drafts and suggestions.
- Founding member benefits: the time-limited live support described in section 4.
- Content: all text, video, audio, frameworks, templates, and other material we make available.
- Your materials: anything you input, upload, or create inside the Service.
3. Eligibility
You must be at least 18 years old and able to enter into a binding contract to use the Service. By purchasing, you confirm that you meet these requirements and that the information you give us is accurate.
4. What you receive
When you join as a founding member, you receive:
- Lifetime access to the Platform. "Lifetime" means for as long as we continue to operate the Platform as a going concern. It does not mean in perpetuity regardless of circumstances. See section 13 for what happens if the Platform is changed or discontinued.
- Access to the AI coach within the Platform.
- All four phases of the programme and the assets you build inside them.
- Founding member live support for six (6) months from your date of purchase, comprising the live monthly group Q&A and access to the founding member group chat. This support is time-limited and ends after six months even though Platform access continues.
We may add to, improve, or update the Platform over time. Where we describe future additions as included, we will use reasonable efforts to provide them, but specific features, sessions, or materials are not guaranteed unless expressly stated.
5. Pricing and payment
- Prices are shown in US dollars (USD) and are inclusive of GST where it applies. The price stated at checkout is the price that applies to your purchase.
- You may pay in full or, where offered, by instalments (a payment plan). If you choose a payment plan, you authorise us and our payment processor to charge each instalment on its due date until the full amount is paid.
- Payments are processed by ThriveCart. We do not store your full card details. Your use of that provider is also subject to their terms.
- If a payment fails, we may suspend your access until the amount owing is paid. Repeated failure may result in cancellation of your access without limiting any amount you still owe.
- Promotional or founding-member pricing is available only while offered and may change at any time.
6. Refunds and your consumer rights
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights.
Polywork is a digital product to which you gain immediate access. For that reason, we do not offer refunds for change of mind once access has been granted. This does not affect your rights under the Australian Consumer Law where the Service is not as described, not provided with due care, or otherwise fails to meet a consumer guarantee.
If you believe the Service is not as described or has failed to meet a consumer guarantee, contact us at support@twofeetin.co.uk, describe the issue, and we will work with you to put it right.
7. Your account and access
- You are responsible for keeping your login details secure and for activity that occurs under your account.
- Access is for you personally. You may not share, resell, sublicense, or transfer your access, or allow others to use your account.
- We may need to verify your identity before granting or restoring access.
8. Acceptable use and community conduct
When using the Platform, the AI coach, live sessions, or any community space, you agree not to:
- share another member's personal information, or anything shared in confidence in a community space, outside that space;
- behave abusively, harass others, or post unlawful, discriminatory, or harmful content;
- record, reproduce, or distribute live sessions or community discussions without consent;
- use the Service to compete with us, including by copying our Content or frameworks to build a competing product or programme;
- attempt to access, scrape, or interfere with the Platform other than as intended.
We may remove content, and suspend or remove access, if you breach this section. Our community spaces are run on third-party tools whose own terms also apply.
9. The AI coach
The AI coach is an automated tool that produces drafts, suggestions, and prompts based on the information you give it and the frameworks within the Platform. It is provided to support your own thinking and decisions.
- Its outputs are general in nature and may be inaccurate, incomplete, or unsuitable for your situation.
- It does not provide financial, legal, tax, medical, or other professional advice, and you should not rely on it as a substitute for advice from a qualified professional.
- You are responsible for reviewing, verifying, and deciding whether to act on anything it produces.
10. No guarantee of results
The Service provides education, tools, and guidance. It does not guarantee any particular outcome, including income, clients, or career results. Your results depend on your own circumstances, effort, and decisions. Any examples, case studies, or testimonials reflect individual experiences and are not a promise of what you will achieve.
11. Intellectual property
- All Content, including the Platform, the frameworks, the AI coach, and all materials we provide, is owned by us or our licensors and is protected by intellectual property laws.
- We grant you a personal, non-exclusive, non-transferable licence to access and use the Content for your own use as part of the Service. You may keep and use the assets you create for yourself, but you may not redistribute, resell, or republish our Content or frameworks.
- You retain ownership of your materials. You grant us a licence to host, store, and process your materials to the extent needed to provide the Service.
12. Third-party tools and links
The Service relies on, and may link to, third-party tools and platforms (for example, the payment processor and community platform). We are not responsible for those services, and your use of them is governed by their own terms and privacy policies.
13. Availability, changes, and discontinuation
We aim to keep the Platform available but do not guarantee uninterrupted access. We may carry out maintenance, update or remove features, or change how the Service works.
If we decide to discontinue the Platform, we will give you reasonable notice where practicable and, where reasonable, provide a way for you to download or retain the assets you have created. "Lifetime access" is subject to this section.
14. Suspension and termination
We may suspend or terminate your access if you breach these terms, fail to pay amounts owing, or use the Service in a way that harms us or other members. You may stop using the Service at any time; this does not entitle you to a refund except as required by law or as set out in section 6.
15. Liability
To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law:
- the Service is provided "as is" and we exclude all implied warranties not required by law;
- we are not liable for indirect, special, or consequential loss, or for loss of profits, revenue, or opportunity;
- where our liability cannot be excluded but can be limited, our liability is limited to, at our option, re-supplying the relevant service or refunding the amount you paid for it;
- our total liability to you for any claim is limited to the total amount you paid us for the Service in the 12 months before the claim arose.
You agree to indemnify us against claims arising from your breach of these terms or your misuse of the Service, to the extent permitted by law.
16. Privacy
We handle your personal information in accordance with our Privacy Policy. By using the Service you consent to that handling.
17. Changes to these terms
We may amend these terms from time to time. The version published at joinpolywork.com/terms applies to your continued use of the Service. If you do not accept an updated version, you should stop using the Service.
18. Governing law
These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
